PRODUCT RETURN/REFUND POLICY

Your digital purchase is provided “As-Is” and no additional features, upgrades or add-ons will be provided unless specifically stated in the product offering.  As is the nature of digital content, all sales are final and no returns or exchanges will be provided. Therefore please take the time to understand what you are purchasing and ask any questions before completing your purchase.  If you have major heartburn about something you purchased, contact us with your concern and proposed solution.

Our guarantee covers our commitment to ensuring that the customer receives what they pay for, promptly, at a competitive price and with our solution-oriented customer service.   The customer is responsible for their own happiness.

Due to the nature of our physical products we strongly suggest inspection upon receipt.  Shipments are packaged carefully to ensure the integrity of the items. Kindly report any damaged cartons upon receipt.  Many items we sell, such as evacuation-related items, are not eligible for return or refund once they have been opened.  It is the customer’s responsibility to make their selections mindfully by expressing concerns and asking questions prior to opening the item. 

A limited number of physical items we sell may be eligible for return within 7 days of receipt provided the item or items are still in the original packaging and the actual item is unopened.  If those conditions are met, the customer may be eligible for a refund upon our receipt of the returned goods, less a 20% restocking fee and excluding the original delivery charge.  Alternatively, if preferred, we may choose to exchange the item.  The restocking fee may be waived at our discretion.

Items marked as “One Size Fits All” or similar are based on the manufacturer’s criteria and experience.  If your life experience has resulted in similar items intended or marked as “One Size Fits All” being either too big or too small for your needs, do not expect our items to be any different.  If you choose to wear or try on an item and then opine that the item is not a good fit, the item is still not eligible for a return or a refund outside of these terms and conditions.   

The customer is responsible for contacting us with questions or concerns prior to purchasing items when they feel that the item may not be a good fit for their requirements.

Returned goods are the customer’s responsibility until it reaches us. Therefore, for your own protection, we recommend that you send the parcel using a delivery service that ensures you for the value of the merchandise. The cost of returning an item to us is your responsibility. Delivery charges are only refundable where goods are determined by us to be faulty and a refund is made.

INTELLECTUAL PROPERTY

The content provided on this Content Management System is owned by TEAM Solutions or their content partners. When a purchase and subsequent download is made from our store, you “the buyer” is merely transferring the digital goods and NOT the ownership rights. Unless specifically stated, digital products are not allowed to be distributed, resold or otherwise modified from its original form. Sizable penalties, legal and otherwise, await Intellectual Property (IP) thieves that seek to misappropriate our digital content.  Yes, we are serious.

PAYMENT

All payments to TEAM-Solutions.US must be in US Dollars.

Unless otherwise noted, payment in full is required at the time the final invoice is received.  All invoices are sent via email and no paper copies are mailed.  Unpaid invoices are subject to a late charge for every week past due equaling 10% of the invoiced amount, repeating every week until paid.

LEGAL COMPLIANCE

Further, you and your organization are responsible for compliance with all applicable laws and governing regulations. Accordingly, this content should only be used or adopted by you or your organization after first being reviewed and approved by your legal counsel. TEAM Solutions assumes no liability in the preparation and distribution of these documents. By obtaining this content, you acknowledge and accept that the recipient of this content, hereafter called the “organization” shall hold harmless and indemnify TEAM Solutions, its owners, employees, content creators and contractors, past, present and future against all claims, suits, actions, costs, counsel fees, expenses, damages, judgments or decrees, by reason of any person or persons or property being damaged or injured by the organization or any of their employees or volunteers, or in any capacity during the progress of their work or service, whether on-duty or off-duty, whether in-transit or stationary and whether by negligence or otherwise.

INFORMATION GATHERED

This content management system, or website, is built using WordPress and uses a variety of 3rd party plugins to help us deliver our services.  We have made our best effort to use plugins from reputable vendors that respect your privacy and ours.  If your interaction with us involves the licensing of product (fee-based and free), enrolling in a class or commenting on our blog your email will be retained so that licensed content can be updated, custom content can be shared in the form of an occasional newsletter, class enrollment can be verified or for any other legitimate business purpose in our discretion.

HOLD HARMLESS

The organization shall further save and hold harmless TEAM Solutions, McKenna LLC and Mike McKenna for any injury or fatality sustained by said organization or any person or persons acting under the direction or influence of the organization.

EVENT PARTICIPATION, ACCIDENT WAIVER, AND RELEASE OF LIABILITY FORM

I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN ANY/ALL ACTIVITIES ASSOCIATED WITH THIS EVENT, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault.

I certify that I am physically fit, have sufficiently prepared or trained for participation in this activity, and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in this activity.

I acknowledge that this Accident Waiver and Release of Liability Form will be used by the event holders, sponsors, and organizers of the activity in which I may participate and that it will govern my actions and responsibilities at said activity.

In consideration of my application and permitting me to participate in this activity, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:

(A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this activity, THE FOLLOWING ENTITIES OR PERSONS: McKenna, LLC, TEAM Solutions and/or their directors, officers, employees, volunteers, representatives, and agents, and the activity holders, sponsors, and volunteers;
(B) INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in this activity, whether caused by the negligence of release or otherwise.

I acknowledge that McKenna, LLC, TEAM Solutions and their directors, officers, volunteers, representatives, and agents are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific activity on their behalf. I acknowledge that this activity may involve a test of a person’s physical and mental limits and carries with it the potential for death, serious injury, and property loss. The risks include but are not limited to, those caused by terrain, facilities, temperature, weather, the condition of participants, equipment, vehicular traffic, lack of hydration, and actions of other people including, but not limited to, participants, volunteers, monitors, and/or producers of the activity. These risks are not only inherent to participants but are also present for volunteers.

I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during this activity.

I understand while participating in this activity, I may be photographed. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose by the activity holders, producers, sponsors, organizers, and assigns.

The Accident Waiver and Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

This contract shall apply to all material provided to me by TEAM Solutions, McKenna LLC and Mike McKenna from this date until canceled.  Continued use of this site acts as your acceptance to these conditions.
